Terms of Service
These Terms of Service ("Terms") are a legal agreement between you and mySkillForge ("mySkillForge," "we," "us," or "our") that govern your access to and use of our website, platform, content, and services.
1. Acceptance of Terms
By accessing or using mySkillForge, creating an account, or purchasing a subscription, you agree to be bound by these Terms. If you do not agree, do not use the service.
2. Eligibility and Accounts
- You must be at least 13 years old to use mySkillForge.
- You agree to provide accurate account information and keep your credentials secure.
- You are responsible for all activities that occur under your account, including use by unauthorized parties if credentials are not protected.
- We may suspend or terminate accounts that violate these Terms or create security, legal, or operational risk.
3. Service Description
mySkillForge provides learning content, progress tracking, coding challenges, and related tools. Some features may require a paid subscription and may change over time as we improve the platform.
4. Acceptable Use
You agree to use mySkillForge only for lawful purposes and in compliance with these Terms. You may not:
- Attempt to disrupt, overload, or compromise platform systems.
- Bypass access controls, rate limits, or security protections.
- Use automated means to scrape or extract content at scale without permission.
- Upload or run malicious code, or use challenge execution for abusive activity.
- Infringe third-party rights, including intellectual property rights.
- Use the service for unlawful, harmful, or fraudulent conduct.
5. Content and Intellectual Property
The service, including software, design, text, graphics, course content, and related materials, is owned by mySkillForge or its licensors and is protected by applicable intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the service for personal, non-commercial learning purposes.
6. User Submissions and Code
You retain ownership of code and other content you submit. By submitting content to mySkillForge, you grant us a worldwide, non-exclusive, royalty-free license to host, process, transmit, and display that content solely to operate, secure, and improve the service.
Challenge execution may rely on third-party sandbox infrastructure. You are responsible for your submitted content and ensuring you have rights to submit it.
7. Subscriptions, Billing, and Refunds
- Paid features are billed through third-party payment providers and may be offered on recurring terms.
- You authorize charges for your selected plan, including applicable taxes and fees.
- You may cancel your subscription at any time. Cancellation stops future renewals and does not retroactively void prior charges.
- Refunds are available within 7 days of the initial purchase date. After 7 days, charges are non-refundable except where required by law.
8. Termination
You may stop using the service at any time. We may suspend or terminate access, without prior notice, if we reasonably believe you violated these Terms, created risk, or if required by law. Sections that by nature should survive termination will survive, including ownership, disclaimers, liability limits, and dispute provisions.
9. Disclaimers
The service is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, mySkillForge disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted, error-free, or secure operation at all times.
10. Limitation of Liability
To the maximum extent permitted by law, mySkillForge and its affiliates, officers, employees, and licensors are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, goodwill, or business interruption.
To the maximum extent permitted by law, our aggregate liability arising out of or related to these Terms will not exceed the greater of $100 USD or the amounts you paid to mySkillForge in the 12 months preceding the event giving rise to the claim.
11. Indemnification
You agree to defend, indemnify, and hold harmless mySkillForge and its affiliates, officers, employees, and licensors from claims, liabilities, damages, losses, and expenses arising out of your use of the service, your content, or your violation of these Terms or applicable law.
12. Disputes and Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict of law principles.
Before filing a claim, each party agrees to attempt informal resolution by providing written notice of the dispute and allowing 30 days for good-faith discussion.
Either party may bring an individual claim in small claims court if the claim qualifies. For all other disputes, you and mySkillForge consent to the exclusive jurisdiction and venue of state or federal courts located in California.
13. Changes to Terms
We may update these Terms from time to time. If we make material changes, we will update the effective date and post the revised Terms. Your continued use of the service after changes become effective constitutes acceptance of the updated Terms.
14. General Terms
- Severability: If any part of these Terms is held unenforceable, the remaining provisions remain in full force.
- Waiver: Failure to enforce any provision is not a waiver of future enforcement.
- Assignment: You may not assign these Terms without our consent. We may assign them in connection with a merger, acquisition, or sale of assets.
- Force majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
- Entire agreement: These Terms, together with referenced policies, form the entire agreement between you and mySkillForge regarding the service.
